Introduction

This Backup & Data Protection Policy forms part of Cyber Jogi’s Terms & Conditions, Terms of Service, and other applicable agreements.

It applies to website hosting, VPS, cloud servers, dedicated servers, email hosting, storage, backup, disaster recovery, and other services

where backup or data recovery facilities are provided, whether included in a plan or purchased separately. By ordering or using our services,

you agree to this policy.

Customer Responsibility for Data

Customers are responsible for maintaining current, independent, and recoverable backups of all important data, including:

• Website files, databases, emails, and documents.

• Applications, operating systems, and configurations.

• Credentials, keys, customer records, and business data.

• Software data and any other customer content.

Customers should maintain at least one independent backup outside their primary production environment. Critical data should ideally be stored in a separate location.

The availability of backup facilities does not transfer the customer’s responsibility for protecting their data.

Relationship with Other Policies

This policy supplements Cyber Jogi’s Terms & Conditions and Terms of Service. It does not guarantee permanent data preservation, unlimited retention, or unconditional restoration, nor does it expand our liability beyond applicable contractual terms and law.

Where a specific written service agreement expressly provides different backup commitments, that agreement will apply to the extent stated in it.

Backup Services

Depending on the selected service, Cyber Jogi may offer automated backups, server or VPS backups, virtual machine snapshots, website and database backups, file-level or image-based backups, third-party backup solutions, backup storage, and disaster recovery services.

Backup frequency, retention, capacity, supported workloads, and restoration features are determined by the applicable plan, order, quotation, invoice, or written agreement.

Only the features expressly included in the purchased service are guaranteed as part of that service.

No Absolute Guarantee of Backup or Recovery

Where backup facilities form part of a service, Cyber Jogi will make reasonable efforts to operate them as intended. However, we do not guarantee that every backup will be created, retained, available, complete, uncorrupted, or successfully restored.

Backup and recovery may be affected by hardware or storage failures, software defects, operating system or database corruption, network or power failures, malware, ransomware, cybersecurity incidents, human error, customer configuration, insufficient storage, unsupported applications, third-party failures, maintenance, natural disasters, or other circumstances beyond our reasonable control.

Backups should never be treated as a substitute for an independent customer-controlled backup strategy.

Backup Frequency

Where automated backups are included, they will generally follow the schedule specified for the relevant service.

Schedules may vary or change when reasonably necessary because of security, maintenance, infrastructure capacity, performance, software updates, technology changes, or operational requirements.

Unless a specific backup frequency is expressly guaranteed in writing, a stated schedule is an intended configuration rather than an unconditional guarantee.

Backup Retention

Backup retention depends on the applicable service or backup plan.
Older backup points may be automatically removed when their configured retention period expires. Once deleted, they may no longer be recoverable.
Customers must not assume that backups will remain available beyond the published or contracted retention period.

Backup Storage Capacity

Backup services are subject to the storage allocation included in the applicable plan. Additional storage or an upgraded backup plan may be available at applicable charges.
If storage becomes insufficient, Cyber Jogi may, depending on the service, notify the customer, request additional storage, offer an upgrade, adjust retention according to the configured service, suspend additional backup creation, or take other reasonable operational measures.
Customers are responsible for selecting backup capacity appropriate to their data volume.

Backup Success Does Not Guarantee Recoverability

A backup job reported as successful does not guarantee that every file, database, application, or configuration can be recovered.
Some data may be inaccessible, corrupted, locked, excluded, unsupported, inconsistent, or otherwise unsuitable for restoration.
Where technically feasible, we may perform backup integrity or availability checks. These checks do not guarantee complete application-level recoverability.

VPS and Dedicated Server Services

For self-managed VPS and dedicated server services, customers are responsible for implementing and maintaining an appropriate backup strategy unless a separate backup service is expressly included or purchased.
This includes backup configuration, scheduling, selection, monitoring, credentials, storage allocation, recovery testing, and maintaining independent backup copies.
Cyber Jogi’s server or virtualization infrastructure should not be considered the customer’s sole backup mechanism.

Application and Database Consistency

Backups may not always capture applications or databases in a consistent state.
For critical workloads, customers should use application-aware or database-aware backup methods where supported and ensure that their applications and databases are properly configured for recovery.
Cyber Jogi does not guarantee that a restored application will operate exactly as it did before an incident.

Ransomware, Malware and Cybersecurity Events

Backup facilities may help reduce the risk of data loss caused by malware, ransomware, or other cybersecurity incidents, but no backup system can provide absolute protection.
During or after an incident, some backups may be unavailable or affected, recent recovery points may be unsuitable, older backups may need to be used, and data created after the selected recovery point may be permanently lost.
Where technically feasible, Cyber Jogi may restore an available and suitable backup point.

Restoration Requests

Customers may request restoration through the applicable Cyber Jogi support channel where restoration is supported by their service.
We may require verification of customer identity, account ownership, authorization, the selected backup point, and the requested restoration scope.
Depending on the service, restoration may include a full server, virtual machine, website, individual files, database, or another supported recovery procedure.
All restoration requests are subject to backup availability, integrity, and technical feasibility

Restoration Time

Unless a specific Recovery Time Objective (RTO) is expressly agreed in writing, Cyber Jogi does not guarantee a particular restoration time.
Restoration time may depend on backup size and location, storage and network performance, destination infrastructure, backup integrity, available server resources, data transfer requirements, restoration complexity, concurrent requests, and the nature and severity of the incident.

Recovery Point Objective (RPO)

Unless expressly agreed in writing, Cyber Jogi does not provide a guaranteed Recovery Point Objective (RPO).
Restoration may result in the loss of data created or modified after the selected backup was taken.
Customers requiring specific RPO or RTO commitments should obtain a written business continuity or disaster recovery agreement appropriate to their requirements.

Restoration Charges

Restoration may be included in certain plans or charged separately, depending on the service and the nature of the request.
Additional charges may apply to emergency or large-scale restoration, manual recovery, repeated recovery attempts, data extraction or migration,
specialised recovery procedures, additional backup storage, or third-party recovery services.
Any applicable charges will be communicated where reasonably practicable before the work proceeds.

Customer Data Deletion

If data is deleted from a live production environment, its availability in backup systems depends on the applicable backup schedule and retention period.
Cyber Jogi does not guarantee that deleted data will remain available in backups. Once all applicable backup copies have expired or been deleted, recovery may no longer be possible.

Service Suspension, Cancellation or Expiry

Following service suspension, cancellation, or expiry, associated backup data may remain available only for the applicable retention period.
Unless otherwise agreed in writing, Cyber Jogi is not obligated to retain backup data indefinitely after service termination or expiry.
Customers are responsible for exporting or recovering any required data before termination or the end of the applicable retention period.

Non-Payment and Suspension

Where a service is suspended due to non-payment, a policy violation, security concerns, or another contractual reason, access to backup and restoration facilities may also be restricted.
Backup retention during a suspension period is not guaranteed unless expressly stated in the applicable service agreement.
Customers are responsible for maintaining their service and any required backup subscription to preserve access to the associated facilities.

Third-Party Backup Platforms

Some backup services may use third-party software, technologies, or infrastructure. Their functionality may depend on the provider’s availability, licensing, operation, and technical limitations.
Cyber Jogi is not responsible for failures attributable solely to circumstances beyond our reasonable control involving a third-party provider, subject to applicable law and our contractual obligations.

Encryption and Recovery Credentials

Where supported, backup data may be encrypted during transmission or storage.
If customer-controlled encryption keys, passwords, or recovery credentials are used, customers are responsible for storing them securely. Losing or compromising these credentials may prevent restoration or decryption of backup data.
Cyber Jogi is not responsible for loss of recoverability caused by a customer’s failure to maintain required credentials or encryption keys, except where liability cannot legally be excluded.

Excluded or Unsupported Data

Unless expressly included in the applicable service, Cyber Jogi does not guarantee backup of:
• Unsupported operating systems, applications, or databases.
• External systems, third-party cloud accounts, or customer-owned infrastructure.
• Data outside the subscribed environment.
• Data excluded by backup settings or inaccessible to backup software.
• Data excluded due to storage limitations.
• Workloads not expressly covered by the applicable backup service.
Customers should confirm that their required data and workloads are supported before relying on a backup solution.

Customer Configuration

Backup functionality may be affected by customer-controlled settings, including firewalls, antivirus software, permissions, security policies, storage, operating system or database settings, backup-agent configuration, and network restrictions.
Cyber Jogi is not responsible for backup failures directly caused by incorrect, unsupported, or customer-controlled configurations, subject to applicable law and contractual obligations.

Backup Testing and Disaster Recovery

Customers are strongly encouraged to test the restoration of critical data periodically.
A suitable backup strategy should include backup and recovery testing, business continuity planning, disaster recovery planning, application dependency mapping, failover procedures, and independent backup copies.
For business-critical environments, customers should consider dedicated disaster recovery, replication, or high-availability solutions.

Data Loss and Limitation of Liability

To the maximum extent permitted by applicable law, Cyber Jogi is not liable for loss, corruption, deletion, alteration, unauthorized access, or unavailability of customer data arising from backup or restoration issues, except to the extent such liability cannot lawfully be excluded.
Subject to applicable law and the relevant service agreement, Cyber Jogi is not liable for indirect, incidental, special, consequential, or business losses, including loss of profits, revenue, business opportunities, reputation, anticipated savings, or business interruption.
Nothing in this policy increases Cyber Jogi’s liability beyond the limits permitted under applicable contractual terms and law.

No Waiver of Existing Terms

Nothing in this Backup Policy limits or replaces Cyber Jogi’s other applicable terms, including:
• Terms & Conditions.
• Terms of Service.
• Acceptable Use Policy.
• Cancellation & Refund Policy.
• Privacy Policy.
• Service-specific terms, order forms, invoices, and written agreements.
All applicable policies and agreements should be read together.

Policy Modifications

Cyber Jogi may update this Backup Policy to reflect changes in technology, infrastructure, security practices, backup systems, service offerings, operational requirements, or applicable laws.
The latest version will be published on our official website, subject to applicable contractual and legal requirements.

Customer Acknowledgement

By purchasing or using a Cyber Jogi service, the customer acknowledges and agrees that:
• The customer remains responsible for maintaining appropriate backups of critical data.
• Backup services assist with data protection but do not guarantee against all data loss.
• Backup frequency and retention depend on the applicable service.
• Successful backup jobs do not guarantee complete recoverability.
• Restoration depends on backup availability, integrity, and technical feasibility.
• Specific RPO or RTO commitments apply only when expressly agreed in writing.
• Backup data may be permanently deleted after the applicable retention period or service termination.
• Independent backup copies and periodic recovery testing are strongly recommended.
• The liability limitations in the applicable Terms & Conditions continue to apply.
For critical business or production environments, Cyber Jogi strongly recommends maintaining an independent backup outside the production   infrastructure.
